Tyson Foods Claims Victory Against Competitors

    An attempt to prohibit Springdale-based Tyson Foods Inc. from using its "Raised Without Antibiotics" marketing campaign has been thwarted, according to a statement issued late Friday by Tyson Foods.

    The company noted in the statement that Sanderson Farms, Foster Farms and Perdue Farms filed a motion Friday for a temporary restraining order to halt the multi-million dollar advertising effort by Tyson Foods.

    In a dispute over how to classify ionophores used by Tyson Foods in its raising of poultry, the U.S. Department of Agriculture recently withdrew its previous approval that allowed Tyson Foods to claim its chicken was free of antibiotics. Tyson Foods and the USDA have since worked out a compromise on this issue.

    U.S. Federal Judge Catherine Blake, with the federal District Court in Baltimore, denied the motion and said Tyson Foods had worked with the USDA to modify the marketing campaign.

    Tyson announced in December the company and USDA had agreed to change the labeling for the company's "Raised Without Antibiotics" marketing. The new label notes: "Chicken Raised Without Antibiotics that impact antibiotic resistance in humans." The new labels and marketing is to begin in February, according to Tyson Foods.

    " Tyson has not been a responsible party when it comes to agriculture. This is a large industry that will say whatever is necessary to increase their profit. They have been willing to fund activities that add nutrients to the watershed and at the same time fund activities to deny their actions. We, as consumers need to find alternate sources of chicken. Buy from local sources. Tyson wants to extract the maximum amount of money from the environment in the least amount of time - they don't care about the future. Don't but their product. "
