Jury Finds For Doctor, Hospital

    FAYETTEVILLE — A Washington County Circuit Court jury ruled Friday a Lincoln doctor and Washington Regional Medical Center staff were not negligent in a wrongful death case.

    The case stemmed from Margie Foren’s Oct. 30, 2005, death after undergoing ankle surgery. Foren, of Prairie Grove, was 55 years old.

    Foren’s estate, represented by Andrea Foren, wanted more than $1 million in damages from the insurers of Washington Regional Medical Center and Dr. Susan Ferguson, the Lincoln physician who was Foren’s general practitioner.

    Ferguson and the hospital contended there was no evidence of negligence. They argued Foren died of sudden, unpreventable cardiac arrest, based on autopsy results and medical records.

    Attorneys for the estate said the hospital and doctors were negligent for not monitoring the oxygen level in Foren’s blood, resulting in her respiratory arrest and irreversible brain damage. Foren died after being taken off a respirator.

    The suit also contended Foren was not monitored often enough to detect that her condition was worsening.
